This pathway not only ensures a more certain future but also squarely addresses Indian families’ concerns regarding education, career continuity, and the broader implications of securing a foothold in the U.S. The EB-5 visa program has experienced a significant surge in demand, especially from Indian investors. The program’s popularity grew by 400% between 2016 and 2019. Despite a decline during the COVID-19 pandemic, the demand rebounded strongly with 1,381 applications in 2022, fueled by the program’s reactivation and eased travel restrictions post-pandemic. In Fiscal Year 2023, 2,632 applications were submitted, a substantial increase from earlier years.
In light of recent trends of mass layoffs and job market uncertainty, we have observed a major boost in interest from F-1 and H-1B visa holders looking for a more stable and long-term path to secure their future. The EB-5 program’s Adjustment of Status (AoS) process offers a critical advantage for Indian nationals already in the U.S. on temporary visas, allowing them to file for unrestricted work and travel permits while waiting for their permanent residency without leaving the country. This is a significant boon, given the long backlogs in other visa categories like EB-2 and EB-3. Through AoS, EB-5 investors can swiftly obtain work authorization and a conditional green card, thus ensuring a smoother and more predictable path to U.S. residency.
